Welcome to Artawesome Market

1. Hi, we are Artawesome. welcome! We are happy to have you and we hope you enjoy your visit to our store. When we say “we”, “we” or “Artawesome” it means that we own and operate the Artawesome Market site.
2. Artawesome’s digital marketplace ecosystem helps millions of people around the world, including visual artists, to be creative and earn money online. When you create an account and accept these terms, you become a member of our community. You will have an Artawesome Market account that allows you to buy files and artwork or services such as those available on Artawesome Market as a “buyer” or to sell as a “seller” and to conduct other related transactions.
3. Artawesome Market is a platform that allows members to buy, sell, or license digital items such as website themes, audio and music files, motion graphics project files, software code, vectors, images, and physical artwork sent by post. and gives many other cases. In the Artawesome marketplace, buyers and authors (sellers) transact directly with each other, and we provide a platform to enable transactions. If you have an Artawesome Market account, any transactions will be recorded in the billing section of your profile, and payments made by you to authors through Artawesome Market (as a buyer) and buyers through Artawesome Market to you (as an author or seller) will be recorded.

Note: Our platform is currently in a test mode and does not attract sellers (authors). Also, until further notice, payments can only be made in digital currency (cryptocurrency).

4. The items on the Artawesome market belong to the authors and creators, not us. Items in the Artawesome Marketplace are uploaded at the request of the author. We provide platform services. We do not take ownership of the items.
5. During your stay with us, you agree to abide by the basic rules set out in these terms, so please read and understand them. If you do not accept the terms, you should leave our store because your presence and use of the Artawesome Market site is subject to acceptance of these terms and the policy set for use. The choice is yours to become a member or not!

Artawesome website

6. The Artawesome Market store or the artawesome.com site, as a market and trading platform for digital and artistic works, does not have another branch in the world (until further notice). All the services of buying files and physical or digital artworks and ordering art services or membership as a seller (files and physical or digital artworks) or artist (to receive an order to produce a physical or digital artwork) are done in the form of artawesome.com store.
7. Preview Files: If you download a preview file from our Artawesome Market site, you agree that you will not remove any watermarks or other protection measures from the preview file. You agree that you will use the preview file solely to evaluate a purchase from Artawesome Market and for no other purpose.

How browsing and membership work

8. Browsing: You must be 16 years of age or older to browse Artawesome Market. We do not knowingly collect any information from persons 16 years of age or younger. When browsing the Sites, you agree to follow our policies or guidelines and remember that these Terms apply to any use of the Artawesome Market Site, whether or not you are a member.

Membership

9. Age: You must be 18 years or older to become a member, purchase or order items. If you are under 18 years of age, you must use your parent or guardian to purchase or order items or use the account of a parent or legal guardian who is at least 18 years of age, with their permission, and such adult will be responsible for all of your charges and activities.
10. Account: Membership in Artawesome is free. Once you become a member, you will receive an Artawesome Market account and your Artawesome account can also be used for other Artawesome services. Your membership allows you to “buy” or license items from authors or artists, participate in our online community, and generally contribute to the Artawesome Market by empowering other people to be creative. and earn money. Membership also gives you the opportunity to become an author or seller (see Section 31 – Becoming an Author or Seller (or earn referral income (see Section 12 – Referrals).) and your connection to Product Support and your services and other work records can be tracked in the user panel of this account. Please note that to register an order for the production of artworks (digital download or physical by mail) you must apply through a special form and having a user account and membership is not necessary.
11. Your Responsibility: You promise that the information you give us is true, accurate and complete and that if you register for an Artawesome Market account, you will keep your account information up to date (including a current email address). Your membership is non-transferable, meaning you cannot sell your account. If you have an Artawesome Market account, you are responsible for all use of Artawesome Market, including activities associated with your username and password, so keep your password secure and do not let anyone else use your username or password. Use your pass. You must notify us immediately if you become aware of any unauthorized use of your password or any other breach of security. You must not use a virtual private network or VPN or any other means to avoid compliance with these terms and conditions.

12. Referrals: As part of our affiliate program, you may be eligible to receive marketing income if you refer a new member to Artawesome Market. Here you can learn more about the marketing program and the conditions for applying the marketing link.

How to buy items

This section helps you understand what you’re buying and how that transaction works on the Artawesome Marketplace when you buy or order a product or service.

13. What you are buying:
14. License: When you purchase an item or commission our artists to design it, you acquire the right to use that item. You do not actually acquire the intellectual property of that file or artwork. What you get includes a direct license from the author to use that item, meaning you are not allowed to copy or resell it (in any way). For example, when you buy a calligraphy or painting artwork from us, you are not allowed to publish a printable quality image of it (without paying us royalties) or sell it as NFT or similar. Items are subject to specific terms of use, and these terms are a “license” that we set on the Artawesome Marketplace. This license also applies to you if you download an item that someone else bought for you (since anyone downloading an item must be a member of Artawesome Market). Different types of licenses are available for you in our market. You need to think about how you want to use it so that you can choose the right license to allow it to be used. It is your responsibility to select the correct license. Of course, we have certain license cases that give the buyer or customer the full right to use the work or items, such as: personal signature design, family genealogy design, personal document design that refers to the customer’s exclusive rights, logo and trademark design, and the like.
15. Item support: Authors and artists can choose to support certain items or not. If an author wishes to support an item, this will be specified and announced on the product page or when ordering the production of an artwork or file. All supported items include a specified period of support. You can also purchase additional support for some items. This fee is for more “time” that will be spent on additional support for your product. Note that accessing support for an item requires an Artawesome Market account.

1. Buyer Services: In addition to using the Platform, when you “buy” or “order” an item, you also receive other Artawesome services such as 24-hour buyer support, fraud protection, product quality control, and other related buyer services.

14. The total price of an item in the Artawesome market includes the following:
15. Item Price: The item price consists of the license fee (for the license you choose for the item) and, if applicable, the item support fee (for supported items).
16. Service Fee: This is the buyer service fee that you pay to Artawesome.
17. Handling Fee: In some transactions on the Artawesome Marketplace, the total payment price may include a handling fee.
18. Taxes: Some transactions on the Artawesome Marketplace may be subject to taxes, which may be added to the price. See Section 23 for details on taxes on the Artawesome Marketplace.

The final price is made up of the price of the product and the cost of the service, and it is the price that is specified on the product page or you will be informed after sending the design order request.

Dealing as a buyer:

15. If you have an Artawesome Market account, you can make payments using the “Buy Now” function or using any Artawesome Credits in your Artawesome Market account.
16. Artawesome Credits: Credits available in the Artawesome user panel (such as the amount charged by us as rewards in the user’s wallet or discount coupons) can only be used to pay for Artawesome Market transactions. We will not refund any money deposited into your Artawesome Market account to purchase Artawesome Credit (but you may have rights under applicable consumer law that we do not exclude).
17. If you make a purchase using existing Artawesome Credits, the total price will be deducted from your Artawesome Credits. Your Artawesome Credits may expire if you have not used them within 12 months. See Section 24 for details on Artawesome Credit Expiration.
18. You will be redirected to a payment method provider when using Buy Now.
19. Currency Conversion Fees: You are responsible for all currency conversion fees associated with transactions on the Artawesome Marketplace. Your financial institution performs the currency conversion and may charge you additional fees (we do not control your financial institution’s conversion rates or fees).

This means that you may incur additional charges when purchasing from Artawesome Market (due to your financial institution over which we have no control).

20. Terms of Purchase: When you purchase or order an Artawesome Market item, you do so subject to the following terms:
21. You warrant to us, the author or creator, that you have carefully considered the appropriateness of the license you choose and have chosen correctly.
22. You cannot cancel a full purchase of an item. Also, money paid is non-refundable for custom items.
23. We and the authors (sellers) do not promise that a particular item will still be available on Artawesome Market, so you should download and save it as soon as you purchase (or after completing the order process).
24. Once you have purchased or downloaded an item and paid for it, you receive a non-exclusive license to use the item under the terms set out in the license (non-exclusive means that others may also license the same item).
25. The author (seller) retains ownership of the item and has the right to resell it repeatedly.
26. Your relevant details may be provided to the author of the item in order to facilitate the transaction. For example, for billing and item support services.
27. We reserve the right to enforce against you the terms of a license you have received from an author.
28. If you (the customer) receive customized items (which are in the form of files or physical artworks and are designed to order) through file download or by mail, you undertake to notify us of possible discrepancies with Preview images or the quality declared by the author or creator of the order, You must declare within 2 days by register a ticket in your user panel. Otherwise, your complete satisfaction with the order will be proved to us and you will not have the right to protest.
29. You agree to contact each of our sellers and creators solely through the Artawesome.com communication channels (available in the “Contact Us” section) and any personal contact to the sellers’ email or private communication channels or the authors have no credit and if we are informed of this “violation”, both the buyer and the author (seller) will be subject to fines.

22. We warrant that the Artawesome Marketplace Site will be fit for the purposes described on this Site and that we will provide our Platform Services with reasonable skill and care.
23. Otherwise, we make no express or implied warranties regarding artawesome.com or any affiliate items.
24. WARRANTIES GIVEN BY AUTHORS AND CREATORS: The author or seller of the product you purchase warrants to you that:
25. The goods are of acceptable quality and fit for the purpose for which they are “sold”.
26. The item matches the description provided by the author on the item preview page as well as each item preview of the item.
27. They disclaim any express warranties to you contained in these terms.
28. They have the right to license each item under the applicable license terms.
29. Your use of any product or content in accordance with the applicable license terms does not infringe the intellectual property rights of another person.
30. Product descriptions provided are not false, misleading, fraudulent, illegal or defamatory.
31. This product and its description do not violate any applicable laws or regulations (including laws relating to export control, consumer protection, unfair competition, criminal law, pornography, anti-discrimination, trade practices or fair trade).
32. This item does not contain viruses or other computer code, files or programs designed to limit or destroy the functionality of other computer software or hardware.
33. If the item is marked as “supported”, they will provide you with the services specified in the item’s support policy.
34. They will process your data in accordance with applicable privacy and data protection laws.
35. The seller or creator, upon receiving the order for the production of a work or required items from the customer, will design the ordered item in coordination with the customer and according to his request and will send it to the customer at the appointed time. He undertakes to obtain the full approval of the customer before the final shipment of the order to him through Artawesome.com’s communication channels.

23. Tax:
24. Sales tax. The prices and charges for goods made available to you (whether by Artawesome or the Authors and Sellers) in connection with these Terms do not include consumption and sales tax (sales tax). If a supply is made to you under these Terms or in connection with these Terms to which sales tax applies, the charge you must pay for that supply will be increased by the amount of the sales tax.
25. Other taxes. You are responsible for paying all taxes and duties related to your use of the Artawesome Marketplace wherever they are levied. If applicable, your responsibility will include withholding tax unless we have already processed that withholding tax. If withholding tax is required under applicable law, you will remit the legally required amount to the applicable taxing authority. You shall pay the gross amount of the invoice(s) to Artawesome (or the Sellers) so that the amount received by Artawesome (or the Sellers) after withholding tax is the full amount that Artawesome or the Sellers would have received (without deduction of tax). or was deducted (and it is your responsibility to arrange remittance of the gross amount of the invoice in accordance with Artawesome’s standard processes).
26. Artawesome Purchase Credits Expires: Artawesome Purchase Credits expire if not used within 12 months from the date of purchase and are forfeited 12 months after the anniversary of the date of purchase. We usually try to tell you in advance when Artawesome Credits will expire and be destroyed, but this is not always possible and we do not promise to give you notice. Check your user panel and membership regularly for expiration date details. If you have different rights under applicable consumer law, we do not exclude them.

If you have not used your Artawesome Credits within 12 months, they may expire.

25. Incorrectly priced items or incorrect information: Despite our reasonable efforts, items may be listed at an incorrect price or with incorrect information. If this happens, we may cancel or reverse the transaction, even after it has been completed and payment has been processed. If we do, we will immediately arrange for any payment to be converted to a purchase credit or refunded and you must not use the item unless you purchase it again at a reasonable price.

26. Due to the nature of the Digital Content, refunds or purchase credits will not be granted unless one of the warranties provided by the Author in Section 22 has been breached, or a refund is required under the Artawesome Marketplace refund rules or under international consumer law.

27. We will evaluate requests for refunds or purchase credits (if you have an Artawesome Market account) based on their value, taking into account the digital nature of Artawesome Market items and the type of product preview available prior to purchase. Also, when you purchase or order the design of a file or a digital or physical artwork (calligraphy, painting, etc.), you acknowledge that you have accepted and trust our capabilities and the skills of our artists by viewing the sample gallery of their works. And you don’t have any objection to the way of its implementation.

There is generally no obligation to provide a refund or credit in the following circumstances:

1. You have changed your mind about an item.
2. You bought the wrong item.
3. You do not have enough expertise to use the item.
4. You want goodwill; Or
5. You can no longer access the item because it has been removed (we recommend that you download items as soon as you purchase them to avoid this).
6. You have received a custom work such as a design order for a digital or physical file or artwork (calligraphic board, painting, etc.) according to our procedure via download or post, and 48 hours have passed since the final delivery and during this period, you did not protest (regarding the quality or declaring a discrepancy).
7. If the author or we decide to issue a refund or purchase credit (if you have an Artawesome Market account), this will usually be done by the same method used to make the purchase. So if the item can be purchased using Artawesome Credits, you will be credited in the “Artawesome Credits” section. If the item was purchased using a specific payment method, the refund will be reversed using the same payment method. Any payment made to you (not Artawesome Credits) will be made in US dollars or its equivalent in accordance with the payment method rules (see Section 19 – Currency Conversion Fees, regarding currency conversion to your local currency).

29. Disputes raised with payment agents: If you, as a buyer, raise a dispute with a payment agent through your Artawesome Market account, this will result in the suspension of your Artawesome Market account until the dispute raised with the payment agent is resolved. , will be This makes resolving related issues very complicated and means that we are unable to make payments or refunds from your Artawesome Market account, so we encourage buyers to contact us directly first to see if we can resolve any concerns.

Fine print: We are not a bank or licensed deposit taker, your credits are not deposits under international law about banks, and that means you don’t get the benefit of any deposit insurance or guarantee under those laws. We don’t act as a fiduciary or as a trustee for you, and we’re not a licensed financial service provider.

Intellectual Property

32. What we own: We own all the Artawesome content that we have put on Artawesome Market (unless otherwise stated and excluding content owned by others). This includes the design, compilation, and look and feel of the Artawesome Market sites, and copyright, trademarks, designs and other intellectual property on Artawesome Market. We own all the trademarks, logos, service marks and trade names on Artawesome Market (unless otherwise stated and excluding these things owned by others). You will not copy, distribute, modify or make derivative works of any of our Artawesome Content or use any of our intellectual property in any way not expressly stated in these terms.
33. What we don’t own: We do not own the items on Artawesome Market; our authors do. Items are uploaded at the direction of the author. So, we cannot take responsibility for the quality, safety or legality of the items. We do not warrant that the items or any member content, code, data or materials available on or via the Artawesome Market do not infringe the intellectual property rights of a third party. (Each author provides promises to you directly when you purchase their item – see section 22 – Warranties authors make.)
34. Copyright, trademark and intellectual property claims: We respect the intellectual property rights of others and we require that authors do the same. If you believe that an item or member content infringes an intellectual property right (including copyright) please see the information in our Intellectual Property Policy.

Our Intellectual Property Policy is where you will find all the information relating to how we treat intellectual property on Artawesome Market including copyright and other rights.

35. Model and property releases: Items are available for commercial use (unless stated otherwise by the Author on an item page). Authors are responsible for obtaining and keeping a model or property release if one is needed; please ask the author directly if you need a copy of a release.

Our use of your information

36. Privacy: We respect your privacy and process your personal information in accordance with our Privacy Policy

37. Confidential Information: We value your information and take reasonable precautions to protect it. While using the Artawesome Market, you may also become aware of confidential information about us or another member. You promise to not disclose any confidential information made available to you through the Artawesome Market to any other person.

Playing fair

38. Prohibited Conduct: We strongly recommend that you don’t make your contact details public on the Artawesome Market or in any public communications via the Artawesome Market sites. Contact details include your email address, street address, Skype name and phone number (but not social network handles). 39. Content removal: We can look at or remove any of your content for any reason at our discretion. Linking; apps made by others

41. Linking to the Artawesome Market: We’d be delighted if you decide to link to Artawesome Market from other sites but you have to link to a full version of a page and not link directly to an image or file hosted on Artawesome Market. That includes no “in-line” linking methods resulting in images hosted on Artawesome Market being displayed on other sites. You must not “frame” any Artawesome Market pages by surrounding those pages with someone else’s content, materials or branding. We reserve the right to insist that any link to the Artawesome Market be discontinued, and to revoke your ability to link to the Artawesome Market.
42. Links from the Artawesome Market: The Artawesome Market site may contain links to other sites. We have no control over or responsibility for anything on those sites, and we do not endorse or support those sites, even if they are affiliated with us.
43. Third party developers: We welcome the contribution of our members and broader community, who offer applications that work with Artawesome Market. You will need to form your own view about these applications and their developers; we’re not able to warrant or endorse those applications and disclaim liability relating to these applications.
44. Eligibility, suspension or termination: Membership is not an automatic right, it is a benefit for community members who follow our terms and policies and treat other community members well. We hope that you will be with us for a long time. But we may, using reasonable discretion, decide whether or not your use of Artawesome Market complies with these terms and our policies. We can suspend or terminate your Artawesome Market account at any time for any reason (acting reasonably of course), including if you:
45. breach these terms or any terms applicable to any of your other Artawesome accounts;
46. breach any of our policies (or policies of any other Artawesome Company);
47. act in a way that does not align with the values of our community; or
48. act in a way that could cause us or member’s harm.

If we do decide to permanently terminate your Artawesome Market account you must not apply for a new account as unfortunately you will no longer be welcome in our community. This decision may also apply to all of your Artawesome accounts you use on other Artawesome sites.

45. Artawesome Companies (in the future): We do not have another company or branch now. but if an indemnity, limitation or disclaimer of liability, warranty or release (a ‘benefit’) is given in our favor in these terms, the Author Terms or Affiliate Terms, we hold that benefit on trust for the other Artawesome Companies (in the future). We may enforce that benefit as trustee for and on behalf of the other Artawesome Companies as beneficiaries under that trust.
46. We may use the services of another Artawesome Company (in the future) to conduct payment or other activities with you, like collecting payments and paying author earnings. If you make a Buy Now payment, we receive your payment as a limited agent for the author and your obligation to pay the author is met when we (or another Artawesome Company in the future) receive the payment successfully.
